Costs

  • Agency commission: 5% of the sale price, plus VAT
  • Legal fees: 1% of the sale price, plus VAT
  • Local Plusvalía tax: This depends on the cadastral value of the property, the municipality in which it is located, and how long the owners have been the owners.
  • 3% Withholding Tax: For non-residents
    This 3% is an advance on the Capital Gains Tax (CGT). The CGT is 19% of the profit (sale price – purchase price, deductible costs such as taxes, commissions, legal fees, notary fees, registration fees, etc.).


    Within a maximum of 4 months after the sale, the seller must submit the CGT return and offset the 3% paid.
  • Sales price: €350,000
  • Agency commission (5% incl. VAT): €21,175
  • Legal fees (1% incl. VAT): €4,235
  • Local Plusvalía tax (example): €4,000
  • 3% Withholding Tax (WHT): €10,500

Net proceeds from sale: €310,090
(€350,000 – €21,175 – €4,235 – €4,000 – €10,500).
Suppose:
  • Purchase price: €250,000
  • Deductible costs on purchase: €25,000
  • Total purchase costs: €275,000

Net proceeds of sale: €310,090
Profit: €310,090 – €275,000 = €35,090
CGT: 19% of €35,090 = €6,667.1
Refund: The seller paid €10,500 as 3% withholding tax. He gets €3,832.9 back (€10,500 – €6,667.10).
